This Privacy Policy explains how Pine Street Capital (“Pine Street Capital”, “we”, “us”, “our”) collects, uses, shares, stores and protects personal information when you visit pinestreetcap.co.za and its subdomains, use our messaging channels, or otherwise interact with our services (together, the “Services”).
We are the responsible party / data controller for the personal information described here.
Contact: admin@pinestreetcap.co.za
Privacy and data requests: admin@pinestreetcap.co.za
If you do not agree with this Policy, please do not use the Services.
1. Scope
This Policy applies to personal information we collect through our websites, landing pages, forms, email programmes, chat and messaging channels (including Telegram), advertising, and any application programming interfaces (APIs) or third-party services we integrate with in order to provide the Services.
This Policy does not apply to third-party websites, brokers, platforms or applications that we link to or that you separately sign up for. Those parties operate under their own privacy policies, and we encourage you to read them.
2. Information we collect
2.1 Information you give us
- Identity and contact details — name, email address, telephone or mobile number, country of residence.
- Account and profile information — username or messaging handle, preferences, and any details you choose to submit through forms, surveys or support requests.
- Communications — the content of messages, emails, chat conversations and support enquiries you send us, including attachments.
- Marketing preferences — your consents, opt-ins and opt-outs.
2.2 Information collected automatically
- Device and technical data — IP address, browser type and version, operating system, device type and identifiers, screen and language settings.
- Usage data — pages and content viewed, links and buttons clicked, referring and exit pages, time and date of access, session duration, and email open and click events.
- Cookies and similar technologies — see section 6.
2.3 Location information
We may derive an approximate location (typically country, region or city) from your IP address, in order to serve region-appropriate content, comply with local rules, and measure marketing performance.
We collect precise or device-level location only where a feature genuinely requires it and only after you have granted permission through your device or browser. You can withdraw that permission at any time in your device or browser settings; if you do, features that depend on location may stop working, but the rest of the Services will continue to function. We do not use precise location data for any purpose other than the specific feature you enabled it for, we do not sell it, and we do not retain it for longer than that purpose requires.
2.4 Information from third parties
We may receive personal information about you from:
- Advertising and social platforms (for example, lead-generation forms completed on a social platform), which pass us the details you submitted on that form;
- Analytics and measurement providers;
- Email and messaging service providers;
- Partners and integrated third-party services accessed via API, where you have authorised that connection or where the partner is permitted to share the information.
Where we access data through a third-party API or integration, we use that data only for the purpose disclosed to you at the time of collection, handle it in accordance with this Policy and with the applicable provider’s terms and policies, do not sell or licence it, do not use it to build independent profiles for unrelated purposes, and delete or stop using it when the purpose has been fulfilled or when access is revoked.
2.5 Information we do not want
Please do not send us special categories of personal information (such as health, biometric, religious, political or trade-union data), government identity numbers, or full payment card numbers. We do not request or need them. We never ask for your broker, bank or platform password, and you should never share it with us or anyone else.
3. How we use your information
- To provide, operate, maintain and improve the Services and the content you request;
- To deliver requested materials, such as guides, analysis, videos and community access;
- To respond to your enquiries and provide support;
- To send you service and transactional messages;
- To send marketing and educational communications where you have consented or where we are otherwise permitted to do so — you can unsubscribe at any time;
- To personalise content and offers, and to measure whether they are useful;
- To measure and attribute the performance of our marketing, including whether a referral resulted in a sign-up with a partner;
- To carry out analytics, research and product development;
- To detect, investigate and prevent fraud, abuse, spam and security incidents;
- To comply with legal, regulatory and record-keeping obligations, and to establish, exercise or defend legal claims.
We do not use your personal information to make decisions based solely on automated processing that produce legal or similarly significant effects for you.
4. Legal bases for processing
Depending on the law that applies to you, we rely on one or more of the following: your consent (which you may withdraw at any time); the performance of a contract with you or steps taken at your request; our legitimate interests in operating, securing, measuring and improving the Services, balanced against your rights; and compliance with a legal obligation.
We process personal information in accordance with the South African Protection of Personal Information Act, 2013 (POPIA), and, where applicable, the EU/UK General Data Protection Regulation.
5. How we share information
We do not sell your personal information, and we do not share it with data brokers or for third-party cross-context behavioural advertising in exchange for payment.
We share personal information only as follows:
- Service providers (operators/processors) who perform functions on our behalf — website and application hosting, email delivery and marketing automation, messaging and chat platforms, workflow automation, cloud storage and productivity tools, analytics, and customer support tooling. They may process your information only on our documented instructions and are bound by confidentiality and security obligations.
- Advertising and measurement platforms, to measure campaign performance and, where you have consented, to deliver relevant advertising. Where possible this uses pseudonymised or hashed identifiers.
- Partners you choose to engage with. If you follow a referral link and sign up with a partner, that partner collects your information directly under its own privacy policy, and may confirm to us that a referral occurred so that we can be credited. We do not receive your login credentials, account balances or trading positions from partners.
- Integrated third-party services that you authorise, and only to the extent necessary to deliver the feature you asked for.
- Legal and safety disclosures — where required by law, court order, or a lawful request by a public authority, or where necessary to protect our rights, your safety, or the safety of others, or to investigate fraud or a security incident.
- Business transfers — in connection with a merger, acquisition, financing or sale of assets, subject to this Policy continuing to apply to the transferred information.
6. Cookies and similar technologies
We use cookies, pixels, tags, local storage and similar technologies to make the site work, remember your preferences, understand how the site is used, and measure marketing.
- Strictly necessary — required for the site to function and to keep it secure.
- Analytics/performance — help us understand usage so we can improve.
- Marketing/advertising — used to measure campaigns and, where permitted, to show relevant ads.
You can control cookies through your browser settings and, where offered, through our cookie banner or preference tool. Blocking some cookies may affect how the site works. Some browsers offer a “Do Not Track” or global privacy control signal; we honour recognised opt-out preference signals where we are legally required to do so.
7. International transfers
We are based in South Africa and use service providers located in other countries, including the European Union and the United States. Where we transfer personal information across borders, we do so in accordance with POPIA section 72 and, where applicable, GDPR Chapter V — relying on your consent, the necessity of the transfer for a contract with you, or appropriate safeguards such as contractual clauses requiring a comparable standard of protection.
8. Data retention
We keep personal information only for as long as we need it for the purposes set out in this Policy, unless a longer period is required by law. As a general guide:
- Marketing contact data — for as long as you remain subscribed, and up to 24 months after your last engagement, after which it is deleted or anonymised.
- Enquiries and support correspondence — up to 24 months after the matter is closed.
- Website analytics and usage data — typically up to 26 months, often in aggregated or pseudonymised form.
- Data obtained via third-party APIs or integrations — only for as long as needed to deliver the feature, and deleted promptly when the purpose ends or you revoke access.
- Records required for legal, tax or accounting purposes — for the period required by applicable law.
When information is no longer needed, we delete it or irreversibly de-identify it.
9. Security
We maintain appropriate technical and organisational measures to protect personal information against loss, misuse, and unauthorised access, disclosure, alteration or destruction. These include encryption in transit (HTTPS/TLS), access controls on a least-privilege basis, multi-factor authentication on administrative accounts, restricted and logged access to data stores, vetting of service providers, and regular review of our systems. We also maintain procedures to identify, assess and respond to security incidents, and will notify you and the relevant regulator where a breach is likely to affect you and notification is required.
No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
10. Your rights and choices
Subject to applicable law, you have the right to:
- Access the personal information we hold about you and be told how it is used;
- Correct or update information that is inaccurate, misleading or incomplete;
- Delete your personal information (see section 11);
- Object to or restrict processing, including direct marketing and profiling for marketing;
- Withdraw consent at any time, without affecting processing already carried out;
- Data portability — receive your information in a structured, commonly used, machine-readable format;
- Lodge a complaint with a supervisory authority (see section 15);
- Not be discriminated against for exercising any of these rights.
To exercise any right, email admin@pinestreetcap.co.za with the subject line “Privacy Request”. We may ask for information to verify your identity, used only for that purpose. We respond within 30 days; if we need more time, we will tell you why and when to expect a response. Exercising your rights is free of charge, unless a request is manifestly unfounded or excessive.
You can unsubscribe from marketing emails at any time using the unsubscribe link in any message, and you can leave any messaging channel or chat at any time.
11. Deleting your data
You may request deletion of your personal information at any time, at no cost, by either:
- emailing admin@pinestreetcap.co.za with the subject line “Delete My Data” from the email address you used with us; or
- replying DELETE to any of our messages on the channel you contacted us through.
We will confirm receipt, verify your identity, and delete or irreversibly anonymise your personal information across our systems and instruct our service providers to do the same, within 30 days. We will tell you when it is done.
We may retain a minimal record of the deletion request itself, plus any information we are legally required to keep (for example for tax or fraud-prevention purposes), and any aggregated or de-identified data that can no longer be linked to you. Deleting your data with us does not delete any account you hold directly with a third party — you will need to contact them separately.
12. Children
The Services are intended for adults and are not directed at children. We do not knowingly collect personal information from anyone under 18 years of age. If you believe a child has provided us with personal information, contact us and we will delete it promptly.
13. Third-party links and services
The Services contain links to third-party websites, brokers, platforms and applications. We do not control those third parties and are not responsible for their content, practices or privacy policies. Once you leave our Services or connect a third-party account, this Policy no longer governs your information.
14. Changes to this Policy
We may update this Policy from time to time. When we do, we will revise the “Last updated” date above. If the changes are material, we will provide more prominent notice — for example by email or a notice on the site — before they take effect. Please review this page periodically.
15. Complaints and contact
If you have a question or concern about this Policy or how we handle your personal information, contact us first at admin@pinestreetcap.co.za — we will try to resolve it directly.
You also have the right to complain to a supervisory authority. In South Africa, that is:
Information Regulator (South Africa)
JD House, 27 Stiemens Street, Braamfontein, Johannesburg, 2001
Email: complaints.IR@justice.gov.za
Website: inforegulator.org.za
If you are in the EU or UK, you may complain to the data protection authority in your country of residence, place of work or place of the alleged infringement.
16. Risk notice
Content on the Services is educational and informational only and is not financial, investment or trading advice. Trading foreign exchange and other leveraged products carries a high level of risk and may not be suitable for everyone. You may lose more than your initial investment. Where we link to a broker or partner, we may receive compensation; this does not change what you pay and does not constitute a recommendation.
